WEB POLICIES

This page contains four policies presented together for your convenience: Cancellation Policy, Website and App Terms, Returns and Refunds Policy, and Privacy Policy. These policies are designed to work with our separate Participant Agreement, Assumption of Risk, and Liability Waiver (Oregon), which is incorporated by reference in your membership contract and accepted separately.

1) Cancellation Policy (Oregon)

This policy governs all active memberships, 12 month commitment plans, class bookings, class packs, personal training sessions, and paid in full plans at Knockout Boxing Club LLC in Oregon.

Definitions
Bill Date: the calendar date each month when autopay processes.
Notice: a written request that includes your full name, phone number, the plan you are cancelling, and the email on file.
Effective Date of Cancellation: 30 days after we receive your Notice unless a statutory or approved exception applies.
• All times are Pacific Time.

How to submit a cancellation request
Submit Notice at least 30 days before your next Bill Date by one of the following:

  1. Email: info@KnockoutBoxing.club

  2. In person: complete the cancellation request at the front desk

  3. Online if you signed up online: use the Mindbody app or website cancellation feature available in your account settings. No conversation with staff is required to cancel online.
    We will email a confirmation with your paid through date within 3 business days. Phone calls, voicemail, social media messages, or verbal statements to staff are not accepted unless followed by an email or the front desk form.

Notice window and final charge
A 30 day Notice applies to all monthly plans. One final autopay may process after you submit Notice, depending on timing relative to your Bill Date. Access remains active through the paid through date. There is no proration or refund for partial billing cycles or unused classes during the final period.
Example: Notice received April 10. Bill Date April 15. One final charge occurs April 15. Access continues until May 14.

12 month commitment plans

Applies to any plan labeled as a 12 month commitment plan, including but not limited to Founders Club Platinum, Pioneers Club Platinum, Family FitCommit, Adults FitCommit, Kids FitCommit.

Minimum term
The minimum term is 12 months from the start date. The contract will not exceed the maximum term allowed by Oregon law.

Early end (member convenience)
You may end early by paying an Early Termination Fee equal to the lesser of two months of dues or the remaining dues in the term. The Early Termination Fee is a fee and does not include additional service time. Upon payment, the membership ends at your current paid through date and no further dues are billed.

Freezes and the commitment clock
Approved freezes pause billing and access for the freeze window and extend the 12 month minimum term by the same number of days. Standard freeze rules apply: maximum two freezes per rolling 12 months, each 7 to 30 days, a freeze fee as displayed on the website or in the app, and the request must be received at least 3 business days before your next Bill Date. You cannot submit a cancellation while frozen; the account must be active to process cancellation.

After month 12
After the 12th month, the plan converts to month to month at the then current rate or as specified in your plan display until cancelled with 30 days Notice. Perks, priority access, and promotional pricing end on the paid through date and do not carry over to future sign ups.

Other plan types

Month to month plans
No minimum term and no early termination fee. A 30 day Notice still applies.

Yearly paid in full plans
Paid in full memberships are non refundable after purchase except where required by law. Up to two freezes within the 12 month term are allowed, each 7 to 30 days, with a freeze fee as displayed. The end date extends by the freeze length.

Class packs and personal training
Class packs expire after the time period displayed at purchase in the Mindbody app or website and are non refundable, non transferable, and cannot be extended except in cases of medical necessity with documentation. Unused classes in a pack are forfeited upon expiration. Personal training sessions must be cancelled at least 24 hours in advance to avoid full session charges. PT packages are non refundable after purchase.

Class cancellations, late cancels, and no shows
Cancel your class reservation in the app. The late cancel window timing and fees are as per the plan settings in the Mindbody app. A no show is charged the class drop in price. Repeated no shows may result in temporary booking limits.

Failed payments during Notice
If a payment fails during your 30 day Notice window, we will retry the charge. A late fee may apply per failed payment cycle as displayed. Access may be suspended until the balance is paid. The Notice window continues to run.

Transfers
Memberships are not transferable. Family plan member changes follow the family plan rules shown at purchase.

Special events and courses
Workshops, courses, and special events may have their own cancellation deadlines and fees that override this policy. See the event description at purchase.

How we confirm your cancellation
We send a confirmation email with your paid through date. If you do not receive confirmation within 3 business days, contact the front desk to ensure your request was received. Keep your confirmation for your records.

Legally required cancellation rights in Oregon

These rights apply to all health spa contracts in Oregon and cannot be waived.

Cooling off period
Cancel without penalty by delivering or mailing written notice before midnight of the third business day after you sign. We will refund all amounts you have paid within 15 days. The statutory notice reads:

BUYER’S RIGHT TO CANCEL
If you wish to cancel this contract, without penalty, you may cancel it by delivering or mailing a written notice to the health spa. The notice must say that you do not wish to be bound by the contract and must be delivered or mailed before midnight of the third business day after you sign this contract. The notice must be mailed to: Knockout Boxing Club LLC, 3409 NE John Olsen Avenue, Hillsboro, OR 97124.

Specific events with refund
You may cancel with a pro rata refund if any of the following occur:
• Death, or a permanent disability or a disability expected to last more than three months, confirmed by a physician agreeable to you and the health spa.
• The health spa relocates or closes the facility closest to your residence on the contract date, and comparable services, facilities, and equipment are not available at another location within 10 miles of that residence.
• The health spa goes out of business or closes all of its facilities in Oregon.
• A planned facility fails to open or promised construction or improvements are not completed by the date stated in your contract.
• We materially change the services promised as part of the initial contract.
• You move to a location more than 10 miles from any facility operated by the health spa that sold the contract.
Refund calculation and timing: Refunds are reduced by the value of services actually received up to the date we receive your notice of cancellation, and are issued within 15 days of receipt of a valid statutory notice. For pre opening refunds, we issue within 10 days where applicable by law.

Documentation
We may require reasonable documentation to process statutory exceptions, such as a doctor’s note for disability or proof of address for a move claim. We do not require notarization or unnecessary documents.


2) Website and App Terms

These Terms apply to your use of our website, our Mindbody hosted pages, and any Knockout Boxing Club mobile or web app experiences. Purchases, cancellations, and freezes are governed by the separate policies referenced in your membership contract.

Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Keep your profile information accurate and current.

Acceptable use
Do not misuse the site or services. Prohibited actions include interfering with security or access controls, scraping or reverse engineering, uploading malware, harassing others, infringing IP, or using the services for unlawful purposes.

Intellectual property
All content, logos, designs, class names, and training programs are owned by Knockout Boxing Club or licensed to us. You receive a limited, non exclusive, non transferable license to access and use the online services for personal, noncommercial purposes. You may not copy, distribute, modify, or create derivative works without permission.

Third party services
We use third party platforms such as Mindbody for scheduling and payments. Your use of those features may be subject to the third party’s terms and privacy policy. Where there is a conflict, these Website and App Terms and our Privacy Policy govern our relationship with you.

Membership changes and cancellations
All membership cancellations, freezes, commitment terms, and statutory rights are governed by the Cancellation Policy above.

Disclaimers and limitation of liability
To the maximum extent allowed by Oregon law and without limiting the separate Liability Waiver, the online services are provided on an “as is” and “as available” basis. We disclaim warranties of merchantability, fitness for a particular purpose, and non infringement. Our aggregate liability for claims arising from the online services will not exceed the amounts you paid for online access to those services, excluding amounts governed by the Liability Waiver.

Termination
We may suspend or terminate accounts that violate these Terms or our Health and Safety rules. Termination of online access does not change your membership status; membership status changes are governed by the Cancellation Policy.

Modifications
We may update these Terms. Material changes will be notified in app or by email. Continued use after the effective date constitutes acceptance.


3) Returns and Refunds Policy

Scope
This policy applies to retail merchandise, class packs, drop ins, and other non membership items. Membership cancellations and refunds are governed by the Cancellation Policy.

Retail merchandise
Return within 14 days in unused, resalable condition with tags for exchange or store credit. Proof of purchase is required. Final sale items are not returnable.

Class packs and drop ins
Refundable within 7 days if entirely unused. After any use or after 7 days they are non refundable. Expiration windows are as shown in your plan settings in the Mindbody app and cannot be extended except as required by law or for a documented medical reason that qualifies for a freeze.

Personal training
Sessions must be cancelled at least 24 hours in advance to avoid full session charges. PT packages are non refundable after purchase. With manager approval, remaining sessions may be transferred to another current member for a transfer fee as displayed.

Method of refund
Refunds are issued to the original form of payment where possible. If the original method cannot be used, we will issue store credit. Processing times may vary by payment provider.

Errors and corrections
We may correct obvious pricing or description errors. If a correction materially affects your order, you may cancel for a full refund of the affected item.

Charge disputes
If you believe a charge is incorrect, contact the front desk within 10 days so we can review. Filing a chargeback without first contacting us may result in temporary suspension of booking privileges. Nothing in this section limits any statutory rights.

Statutory refunds
Cooling off and other legally required refunds are handled under the Cancellation Policy.


4) Privacy Policy

What we collect
Identifiers and contact information, account and profile data, purchase and payment details, class bookings and attendance, communications with us, device and usage data from our site and apps, and any information you choose to share with coaches for training and safety.

How we use data
To provide and improve classes and services, manage memberships and billing, operate our websites and apps, communicate about schedules and policy updates, maintain safety, detect and prevent fraud, and comply with legal obligations.

Sources
Information comes from you, from your use of our services, and from service providers such as Mindbody, payment processors, analytics providers, and security vendors.

Sharing
We share data with service providers who help us operate the club and our online services, including Mindbody and payment processors. We may share information if required by law or to protect people, property, or our rights. We do not sell your personal information.

Your choices
Update your profile in the app, manage marketing email preferences, and request access or deletion where applicable by law by emailing info@KnockoutBoxing.club. For online sign ups, you can cancel memberships online as described in the Cancellation Policy.

Security and retention
We use reasonable administrative, technical, and physical safeguards. We retain information only as long as needed for the purposes described above, to meet legal obligations, resolve disputes, and enforce our agreements.

Children
Parents or legal guardians control accounts for minors. For assistance with a minor’s information, contact us using the email above.

Third party links and services
Our website and apps may link to third party sites or use third party features. Their privacy practices are governed by their own policies.

Updates
We may update this Privacy Policy. Material changes will be posted in app or on our site and become effective on the date indicated. Continued use after the effective date constitutes acceptance.
